RENTAL AGREEMENT & LIABILITY WAIVER

Facilitrip Rental Agreement and Liability Waiver

This Rental Agreement (“Agreement”) is entered into between you, the Client, and Facilitrip USA LLC (“Facilitrip”, “we”, “us”, or “our”). Facilitrip remains the sole owner of all rental equipment. By signing and/or accepting this Agreement and receiving rental equipment, the Client acknowledges that they have read, understood and agree to the terms below.

1. Reservation and Payment

a. Reservations are confirmed upon full payment by credit/debit card, Strip, Apple Pay PayPal or other approved method at the time of booking.

b. The Client authorizes Facilitrip to process charges for rental fees, changes, incidentals, loss/damage replacement costs, and any applicable service fees.

c. A confirmation email will be sent within 24 hours of booking. If not received, the Client must contact Facilitrip to confirm their reservation.

d. Product colors and models may vary from images shown online.

2. Delivery, Possession and Use

a. Complimentary delivery and pick-up may be offered in select Orlando-area locations, including but not limited to Orlando, Kissimmee, Davenport, and Disney park areas.

b. The Client must provide the delivery and pickup locations within the defined service area. Facilitrip may include but is not limited to theme parks, hotels, vacation homes and agreed addresses in the Orlando area.

c. Locations outside designated free zones may incur an additional delivery fee, disclosed prior to confirmation.

d. Facilitrip will communicate scheduled delivery and pickup times via email. The Client must be available at these times. 

e. Delivery and pick-up times are estimated and may vary due to routing, traffic, or operational factors.

f. The Client is responsible for ensuring items are available at the agreed location and time.

g. Equipment must be ready for pick-up at the designated location by the scheduled time to avoid additional fees.

h. If the Client fails to meet delivery/pickup times, Facilitrip may reschedule at its discretion; additional fees may apply.

i. The Client agrees to inspect all items upon receipt and notify Facilitrip immediately of any defects.

j. Children’s equipment must be used only for its intended purpose and within specified safety guidelines.

3. Changes, Extensions and Cancellations

a. Any requested changes or extensions must be made at least 24 hours before the scheduled delivery.

b. Rescheduling requests made at least 7 days in advance may be accommodated without penalty, subject to availability.

c. Late rescheduling requests may incur an administrative fee.

d. Extensions may incur additional daily charges at Facilitrip’s discretion.

e. Extensions requested after delivery are subject to standard daily rates and availability.

f. Cancellation policy is as follows:

  • Full refund if canceled 48 hours or more prior to the rental date.

  • Cancellations within 48 hours will incur a minimum rental fee.

4. Damage, Loss or Non-Return of Equipment

a. The Client accepts full responsibility for all equipment from the time of delivery until the confirmed return.

b. The Client agrees to pay the full replacement cost for items that are lost, stolen, damaged or not returned within 48 hours of the rental end date.

c. Facilitrip may charge the Client’s payment method on file for replacement costs.

d. Replacement costs include all parts and accessories (e.g., straps, adapters, covers, etc.).

5. Optional Insurance and Waiver

a. Optional insurance covering damage, theft or loss is available prior to taking possession.

b. Insurance is only valid if purchased before possession and if the client adheres to all material terms of this Agreement.

c. Insurance does not cover:

  • Abandoned or forgotten items at parks, venues or transportation.

  • Items left unsecured at hotels, homes or unattended locations.

  • Misuse or intentional damage

  • Use outside intended environments

  • Exceeding manufacturer weight or usage limits

d.  In cases of theft or loss, the Client must immediately notify local security or police and provide a report to Facilitrip. 

e. Replacement costs without insurance may be charged at full retail value, including but not limited to strollers and accessories.

6. Liability Waiver

a. By using Facilitrip equipment, the Client (and any authorized user) accepts full responsibility and assumes all risk.

b. Facilitrip disclaims all warranties — express or implied — regarding rental equipment.

c. Facilitrip, its partners, employees, affiliates, and agents are not liable for any accidents, injuries, property damage, loss or death.

d. The Client agrees to hold harmless and indemnify Facilitrip against all claimed liabilities.

e. This Agreement is governed by the laws of the State of Florida.

7. Weather-Related Adjustments

a.  In the event of severe weather or government-issued restrictions, Facilitrip may reschedule deliveries or pick-ups.
b.  If weather prevents safe retrieval, the Client must keep equipment secure until a new time is arranged.
c. Rental extensions due to weather-related delays may be granted at Facilitrip’s discretion

8. SMS & Communications Consent

By providing a mobile number, the Client consents to receive SMS messages for delivery/pickup updates. Message/data rates may apply. Clients may opt out by replying “STOP”.
